Staffing

The goal of the attorneys in the Staffing Practice Area is to provide today's staffing companies with the comprehensive legal services they require for all of their business needs. As experienced practitioners in a broad range of practice areas, we have the ability to help clients prioritize their legal needs and manage their legal work in a cost-effective manner.

Our attorneys have experience working with companies of all sizes in such diverse staffing niches as health care, IT, financial, clerical, technical, and professional. In addition, we understand the nuances of the staffing industry and recognize the concerns of entrepreneurs, company management and general counsel in the industry. We are also experienced in serving the needs of vendors to the staffing industry.

We have provided service and advised companies that engage in meeting a variety of staffing needs including:

  • Employment Issues – Providing unique insight of industry specific experience in response to OFCCP inquiry, Discrimination charges, Immigration issues, Franchise issues
  • Contract services – Drafting contracts for independent contractors, employment, non-compete, confidentiality, reviewing and drafting of client contracts
  • Temporary help – Providing unique experience and advice regarding contingent workforce issues
  • Employee leasing (PEO) – Assisting clients in obtaining licensure and compliance with state laws. Drafting client services agreements/negotiating agreements on behalf of companies using PEO services
  • Payroll services – Drafting and negotiating agreements for vendors and clients for payroll services and payroll transfer services
  • Managed services – Vendor on premises, RPO contracts and issues
  • Daily pay – Advice and contracts for use in daily pay venues
  • Direct Placement – Advice and drafting of retainer search and contingent search agreements
  • Funding – Representing both funding companies and clients seeking funding arrangements

Gentry Locke's Staffing group is led by Diane J. Geller, a practicing attorney for over 25 years and admitted to practice in Florida, New York and Tennessee and application pending in Virginia. For over 19 years, Ms. Geller has serviced contingent staffing companies and their vendors by offering the industry specific knowledge. Prior to entering private practice Ms. Geller served as General Counsel for a $600 million, publicly traded national staffing company specializing in supplemental staffing, contract staffing, employee leasing and funding of independent staffing services. As General Counsel, Ms. Geller was responsible for overseeing the daily legal and risk management aspects of the company with its unique staffing issues. Her in-house background and private practice experience provides an invaluable perspective when guiding staffing clients through the issues they confront including contract negotiations, employment law matters, receivables financing, franchise law issues, litigation and general corporate matters.

In an effort to prevent and avoid unnecessary delays, the Firm's Staffing Practice Group attorneys work closely with their clients in order to provide quality, time-sensitive, practical, industry-appropriate representation. When advisors in a non-legal field are required, we offer our clients a network of contracts and other resources in receivables funding, management consulting, accounting, insurance and debt and equity financing.
