Employer Alert: Pursuant to Families First Coronavirus Response Act, DOL issues Notice that Covered Employers are Required to Post

Today (March 25, 2020) the Department of Labor Wage and Hour Division (WHD) released the Notice outlining employee rights under the Families First Coronavirus Response Act that covered employers are required to post. WHD also published a helpful “Frequently Asked Questions” (FAQ) document regarding the required posting. The Notice and FAQ can be found here (scroll down to Posters section).
The Notice must be posted on or before April 1, 2020, in a conspicuous place on the employer’s premises. With many employees teleworking during this pandemic, employers may satisfy this requirement by emailing or direct mailing this notice to employees, or posting this notice on an employee information internal or external website. The DOL states that employers that they are not required to provide this Notice to recently laid-off employees. The Notice must only be shared with current employees. (FAQ no. 3.)
