NLRB & Unions

We make no apologies for the fact that we believe that businesses are better off if they are union-free. We regularly represent businesses faced with union organizing campaigns and initiatives. In so doing, we strive to ensure that our clients oppose the union using lawful means and strategies.

Union Avoidance

With their large and steady decline in numbers, we are keenly aware that unions desperately seek to organize more workplaces. We regularly train and educate our corporate contacts to be alert for the first hint of any union organizing. In such circumstances, time is of the essence. We have the experience to proactively respond to union organizing efforts. This experience includes anti-card signing efforts and meetings with management and their supervisors to understand the dynamics and create a prompt and effective plan of counterattack. In circumstances when a union files a petition, we regularly represent employers throughout the campaign in an effort to lawfully defeat the union during the NLRB election.

Unfair Labor Practice (ULP) Litigation

We have substantial experience representing employers on unfair labor practice charges before the National Labor Relations Board. This includes traditional ULP’s, as well as emerging protected concerted activity (PCA) charges under Section 7. The closest NLRB office is in Winston Salem, North Carolina (which is now part of the Atlanta region). We have substantial experience with the NLRB’s Winston-Salem (and Atlanta) lawyers, investigators, and personnel.

Collective Bargaining (Management)

As experienced labor practitioners know, the bargaining table is where union promises are put to the test. We have front line and behind the scenes experience in representing management’s interests at the bargaining table. Our work in this area includes the critical pre-negotiation analysis to establish the company’s priorities prior to the formal negotiations. Our legal knowledge and practical experience allow us to “bargain in good faith” while achieving the company’s strategic objectives.

Union Strikes & Injunctions

Unions still call strikes. Strikes result in picket lines in which emotions run high. In such circumstances, prompt and effective labor counsel is critical. We have assisted employers with pre-strike preparations including staffing and security issues. When strikes occur and problems develop, we have experience to take action. Such actions may include obtaining a law and order injunction to protect the company.
