New Overtime Rules Effective January 1, 2020
The long-anticipated “Final Rule” setting the salary thresholds employers are required to pay in order to satisfy the “salaried basis” requirement for the “white collar” exemptions was released by the US Department of Labor (“DOL”) on September 24, 2019. It will become effective on January 1, 2020. After receiving more than 116,000 comments, the DOL set the new minimum salary requirement at $684/week (or $35,568 annually). No changes were made in the “duties” tests that a salaried employee must meet to be exempt.
