ROANOKE, VA (May 21, 2015) – The Judicial Council of Virginia has named Gentry Locke’s Senior Counsel, Justice Cynthia D. Kinser, as the recipient of the 2014 Harry L. Carrico Outstanding Career Service Award. The Harry L. Carrico Outstanding Career Service Award is presented annually by the Judicial Council of Virginia to a Virginia judge who, over an extended career, has demonstrated exceptional leadership in the administration of the courts while exhibiting the traits of integrity, courtesy, impartiality, wisdom and humility. Virginia’s “Good Faith” Statute Requires Good Timing

Recently, litigants have been relying heavily on Virginia Code Section 8.01-271.1 to shift their legal expenses to the opposing party. Code Section 8.01-271.1 is generally known as Virginia’s “good faith” statute and requires that all pleadings, motions, or other papers filed during litigation are filed for a proper purpose, be well grounded in fact, warranted by existing law, or a good faith argument to extend, modify or reverse existing law. United States District Court for the Western District of Virginia Our client, a building industry manufacturer, has successfully persisted in its defense of hostile work environment/sexual harassment claims filed by a former employee. The case was originally dismissed on summary judgment in 2013. On appeal, the Fourth Circuit Court of Appeals affirmed the dismissal of the retaliation claim, but remanded the hostile work environment claim for trial. Following a three-day jury trial in federal court in Roanoke on April 21, 2015, a jury vindicated the employer and dismissed the claim.
