The Plaintiff suffered traumatic brain injury, blindness, and other injuries following the failure of a CNC machine (a computer-controlled industrial drill).

During surgery to repair a redo rotator cuff, the surgery itself caused axillary artery and brachial plexus nerve injury to the patient. The patient then developed Complex Regional Pain Syndrome II and has no use of his hand. He is disabled, prevented from gainful employment, and is dependent upon high levels of narcotic pain medications.

Scott, Jr., co-counsel The Plaintiff (who is deceased) developed blood flow problems in her left leg, which was treated by an interventional radiologist. During that treatment, that radiologist elected to perform an unnecessary procedure on her right leg. The tractor-trailer’s insurance carrier became insolvent and the Plaintiff had to recover from an insurance guaranty association. The Plaintiff recovered the maximum amount available through the guaranty association.

Motion to Dismiss Granted in Defamation and Malicious Prosecution Case

Gentry Locke Rakes & Moore for the Defense Circuit Court of Franklin County Gentry Locke represented an individual defendant in a multi-count defamation and malicious prosecution case. Plaintiff sought $250,000 in compensatory damages, plus $350,000 in punitive damages. We filed demurrers (motions to dismiss) to all claims on behalf of our client. At the conclusion of the hearing, the Court granted our client’s demurrer to the malicious prosecution claim “with prejudice,” meaning it cannot be brought again.
