Monica T. Monday of Gentry Locke Rakes & Moore for the Appellee. The Court of Appeals of Virginia has affirmed an equitable distribution award in a divorce appeal and has awarded the wife her appellate attorney’s fees. The court found no error in the trial court’s ruling that gives 55% of the marital property to the wife and considered the husband’s poor relationship with his stepdaughter. Finding that the husband’s appeal lacked merit, the court also granted the wife’s request for the husband to pay her appellate attorney’s fees.

Gentry Locke Rakes & Moore for the Plaintiff. Gentry Locke attorneys Matt Broughton, Greg Habeeb, and Cate Huff, in association with outside counsel Robert Evans, represented our client in a products liability case arising out of workplace accident. The Plaintiff suffered traumatic brain injury, blindness, and other injuries following the failure of a CNC machine (a computer-controlled industrial drill).

Gentry Locke Rakes & Moore for the Plaintiff. During surgery to repair a redo rotator cuff, the surgery itself caused axillary artery and brachial plexus nerve injury to the patient. The patient then developed Complex Regional Pain Syndrome II and has no use of his hand. He is disabled, prevented from gainful employment, and is dependent upon high levels of narcotic pain medications.

The case was tried in Staunton Circuit Court. Gentry Locke Rakes & Moore for the Plaintiff; outside attorney H. David Natkin, co-counsel. Gentry Locke attorney Benjamin D. Byrd and co-counsel H. David Natkin represented a home health care nurse who was the victim of a sexual assault that was perpetrated by the client for whom she was providing care.

Wise County Circuit Court Gentry Locke Rakes & Moore for the Plaintiff Thomas R. Scott, Jr., co-counsel The Plaintiff (who is deceased) developed blood flow problems in her left leg, which was treated by an interventional radiologist. During that treatment, that radiologist elected to perform an unnecessary procedure on her right leg. This led to multiple complications, additional procedures, amputation of the right leg below the knee, and subsequent death. Gentry Locke Rakes & Moore for the Plaintiff Roanoke City Circuit Court Our client (a minor) was walking to school when she was hit by a car. She suffered serious injuries, including injuries to her knee, and had medical expenses in excess of $34,000.00. The Defendant only had insurance coverage of $100,000 and paid the full amount of the policy.

Gentry Locke Rakes & Moore for the Plaintiff Rockingham County Circuit Court Our client was rear-ended by an uninsured motorist and suffered injuries to her neck and back. She ultimately required neck surgery. Plaintiff sought recover under her own uninsured motorist policy.

Gentry Locke Rakes & Moore for the Plaintiff King William County Circuit Court Our client suffered substantial injuries when a tractor-trailer came into her lane of travel and hit her head-on. The Plaintiff lost several teeth, required extensive oral surgery, and suffered a traumatic brain injury. The tractor-trailer’s insurance carrier became insolvent and the Plaintiff had to recover from an insurance guaranty association. The Plaintiff recovered the maximum amount available through the guaranty association.

Gentry Locke Rakes & Moore for the Defense Circuit Court of Franklin County Gentry Locke represented an individual defendant in a multi-count defamation and malicious prosecution case. Plaintiff sought $250,000 in compensatory damages, plus $350,000 in punitive damages. We filed demurrers (motions to dismiss) to all claims on behalf of our client. At the conclusion of the hearing, the Court granted our client’s demurrer to the malicious prosecution claim “with prejudice,” meaning it cannot be brought again.
